This is the standard license that accompanies every TSARKOV STUDIO project. It is drafted on the basis of the Bulgarian Copyright and Neighboring Rights Act (ЗАПСП), relevant EU directives (DSM, eIDAS, reverse-charge VAT) and the industry standards of ASMP, APA, AOP and the PLUS Coalition.
What's covered
AI training opt-out
Explicit opt-out under Art. 4 of the DSM Directive (EU) 2019/790. The photographs may not be used for AI training.
Author's rights intact
Copyright and moral rights (attribution, integrity) remain with the photographer — per ЗАПСП Art. 15. They cannot be transferred.
EU B2B reverse charge
For EU clients with a valid VAT ID — invoice issued without VAT under ЗДДС Art. 21(2) and Art. 44 of Directive 2006/112/EC.
Bestseller clause
If the client's campaign performs disproportionately well versus the agreed fee — the photographer is entitled to fair additional consideration (ЗАПСП Art. 38(3)).
E-signature
Valid with a qualified electronic signature under eIDAS Regulation (EU) 910/2014 — no need for a wet-ink signature.
